Chapter 13 Reorganization Bankruptcy for Tax Debt
In some cases, your text may be too recent to be discharged or to qualify for Chapter 7 bankruptcy. In that case, Chapter 13 bankruptcy allows the tax debt to be scheduled into a 3 to 5 year repayment plan. This is an option if you receive a regular income yet your debt is too great to repay with that income as it stands. When you file for Chapter 13 bankruptcy, an automatic stay goes into effect, which means that the IRS cannot garnish your wages or seize your bank accounts. It also means that during the repayment plan period, new penalties and interest cannot be added. What’s the end result? If you continuously pay according to the scheduled repayment plan, any remaining debt will be discharged after the repayment period. At the end of your payment schedule, you will be financially free!
